Thune Files Cloture on the Clarity Act, Setting Up September Vote
Senate Majority Leader John Thune has filed cloture on the motion to proceed to the Clarity Act. The move sets up the first Senate vote on the crypto market structure bill.
Crypto journalist Eleanor Terrett confirmed the filing on X, reporting that the Senate will vote after lawmakers return from recess, at 2:15 PM on Tuesday, September 15.
The official Senate Cloakroom account also posted the update, stating that Thune filed cloture on the motion to proceed to Calendar No. 423, H.R. 3633, the Clarity Act.
Politico reporter Jordain Carney separately confirmed the September timing, noting the Senate is "teeing up" the bill for when members return.
This is the first real procedural step for the bill since it passed the House last year.
What Is the Clarity Act?
The Clarity Act, officially H.R. 3633, is a bill meant to set clear rules for crypto markets in the United States.
It would split oversight between two agencies. The SEC would handle securities-like tokens. The CFTC would handle digital commodities.
The House passed the bill back in July 2025 with support from both parties. The Senate Banking Committee approved its own version in May 2026, by a vote of 15 to 9.
Since then, negotiators have worked on merging the House and Senate texts into one bill.
Why Cloture Matters for the Clarity Act
Cloture is a Senate rule used to end debate on a bill. It does not pass the bill by itself.
To file cloture, a senator needs support from at least 16 colleagues. Thune got that support before the August recess began.
But the actual cloture vote needs 60 senators to say yes. That is a much higher bar.
If cloture passes, the Senate can begin full debate on the Clarity Act. If it fails, the bill stalls again.
What Happens on September 15
The Senate returns from its summer break on September 14. The cloture vote is scheduled for the next day, at 2:15 PM.
This timing was agreed to by the Senate earlier this week, according to Terrett's report.
Lawmakers will have a narrow window to act. Some reports note the Senate has only about 13 working days before members shift focus to the midterm elections.
Sticking Points Still Unresolved
A few issues remain before the Clarity Act can gather 60 votes.
Stablecoin yield. Some Republican senators want protections for community banks. They worry stablecoin rewards could pull deposits away from local banks.
Ethics provisions. Democrats want stronger rules covering government officials who hold crypto assets. The White House has not yet responded to a new divestment proposal.
Law enforcement concerns. Some prosecutors and law enforcement groups oppose a provision that would shield non-custodial software developers from certain liability.
These disputes are why prediction markets remain cautious. According to Best Crypto Presales, Polymarket data shows only a 17% chance the bill becomes law in 2026, though that is up slightly from a recent low of 13%.
Industry Reaction to the Clarity Act Filing
Coinbase CEO Brian Armstrong called the earlier delay disappointing but said he appreciated Thune's commitment to bring the bill back in September.
Industry groups have pushed for the bill for over a year, arguing that clear rules would help US crypto firms compete globally.
